Recruitment privacy policy

This privacy policy aims to inform you of the reasons and conditions under which the UNITY-SC Group (hereafter “Unity SC”) collects and processes your personal data in the context of internal recruitment, in accordance with data protection regulations, particularly Regulation (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereafter, “GDPR”).

1. Data Controller of Your Personal Data

We, Unity SC, located at 611 rue Aristide Bergès, Z.A. de Pré Millet – 38330 MONTBONNOT-SAINT-MARTIN, act as the data controller of your personal data in the context of internal recruitments we conduct.

Your personal data may be directly communicated to the relevant subsidiary of the Unity SC Group, as follows:

In such cases, the recipient company/office of your application acts as the data controller.

2. Categories of Personal Data Processed

By personal data, we mean any information directly or indirectly relating to an identified or identifiable natural person, in accordance with Article 4(1) of the GDPR.

For candidates, these data may include:

  • Identification data (name and surname(s), telephone number, email address);
  • Curriculum vitae data (photo, date of birth, educational/academic background, postal address, skills, professional experiences, interests, etc.);
  • Cover letter (skills, personal and professional qualities, etc.);
  • Data concerning the evaluation of skills and aptitudes.

In some cases, our recruiters may also request verification documents, which will not be retained, including:

  • A copy of your highest qualification;
  • An extract from your criminal record (b3) where required by law or regulation (exceptional cases justified by the nature of the position to be filled).

When qualifying candidates, we may also check their references and possible recommendations. In this context, we will only process the identification data of our contacts and their feedback on candidates.

3. Source of Your Personal Data

We obtain these personal data as follows:

– When you respond to a job offer posted by us, via the website https://unity-sc.com/ (hereafter the “Site”) or partner sites (Indeed, CadreEmploi, etc.).
– When you submit a speculative application, particularly via the form provided for this purpose on the Site.

4. Purposes of Personal Data Processing by Unity SC as Data Controller and Legal Bases

Your personal data are collected solely for legitimate and relevant professional purposes, and all reasonably necessary measures are taken to ensure that the personal data we process are protected, accurate, and up-to-date.

Your personal data may be processed by Unity SC, where we act as the data controller, for the following purposes :

4.1 Identification of relevant profiles to generate applications and pre-selection of candidates: submission of applications via the Site or partner sites (e.g., Indeed, CadreEmploi), creation of a resume database.

No information about you will be communicated to third parties.

The legal bases for the personal data processing mentioned in this paragraph are:

  • for the submission of applications via the Site or partner sites: the execution of pre-contractual measures and the establishment of the contractual relationship between Unity SC and job candidates, and the legitimate interest;
  • the creation of a resume database: consent.

Candidates may, of course, object to the use of their personal data for the purpose of offering them positions that may interest them or in response to their application requests. In this case, we will add their personal data to an opt-out list.

4.2 Management of an Opt-Out List

The names, surnames, and contact details of candidates who have exercised their right to object will be added to an opt-out list to avoid contacting them in the context of profiling or recruitment operations.

The legal basis for the personal data processing mentioned in this paragraph is the respect of our legal or regulatory obligation to enable you to effectively exercise your right to object.

The methods for exercising this right are detailed in the “Exercise of Your Rights” section below.

4.3 Interviewing and assessing the candidate’s ability to perform a job and measure their professional skills

As a candidate, your personal data may be processed by Unity SC recruiters for the following purposes:

  • invitation and participation in telephone or onsite interviews in our facilities;
  • assessment of skills for the position you are interested in;
  • taking references from former employers;
  • searching for positions that you may suit, if applicable.

The legal bases for the personal data processing mentioned in this paragraph are:

  • the execution of pre-contractual measures and the establishment of the contractual relationship between Unity SC and job candidates;
  • the legitimate interest of Unity SC.

4.4 Review and Processing of Any Complaint from a Candidate

Unity SC may process your personal data in case of a complaint from you.

The legal basis for the personal data processing mentioned in this paragraph is the respect of our legal or regulatory obligation.

4.5 Retention of Records by Unity SC to Exercise or Defend Its Rights in Court

Certain information about you will be retained by Unity SC to defend against possible legal actions before civil and/or criminal courts. Unity SC may, for example, need to defend against a discrimination lawsuit and, in this context, use the records submitted concerning selected candidates.

The legal basis for the personal data processing mentioned in this paragraph is the legitimate interest of Unity SC to exercise and defend its rights in court.

5. Recipients of Personal Data

To process personal data for the purposes described above, this data may potentially be communicated to the following persons, to the extent necessary for the performance of their tasks and role:

  • any authorized employee of Unity SC or its subsidiaries involved in the recruitment of candidates;
  • our IT subcontractor hosting the Site, namely: Netsample;
  • any governmental, administrative, judicial authority, on the basis of a law, regulation, or binding decision.
6. Transfer of Personal Data Outside the European Economic Area

It is possible that your personal data may sometimes be transferred outside the European Union through our subsidiaries, subcontractors, and/or partners.

Certain recipients are located in countries that have been subject to an adequacy decision (total or partial) by the European Commission, which considers them as providing an adequate level of personal data protection. These countries include:

  • The United States, recognized as partially adequate because only personal data transfers to certified “DPF” entities do not require framing by transfer tools.
  • Japan, recognized as an adequate country where personal data transfers do not require framing by additional transfer tools.
  • South Korea, recognized as an adequate country where personal data transfers do not require framing by additional transfer tools.

For other countries not considered as providing an adequate level of protection, such as China, Singapore, Taiwan, Africa, Unity SC makes all efforts to implement necessary and sufficient guarantees to ensure the level of protection required by the Regulation (notably, on a case-by-case basis, by developing binding corporate rules, known as “BCR – Binding Corporate Rules,” or any other mechanism compliant with the Regulation).

7. Retention Duration of Your Personal Data

The retention periods for candidates’ personal data are listed in the table below. These maximum retention periods may vary if legal or regulatory requirements set different durations.

Additionally, these durations may be extended by the statute of limitations for legal actions (typically 5 years according to common law prescription), and for legitimate purposes related to the needs of the company, including, but not limited to, ensuring the defense of its interests, responding to legal, regulatory, judicial order requirements, or cooperating in an investigation or judicial procedure.

These data will then no longer be retained in active databases but will be subject to intermediate archiving.

8. Exercise of Your Rights

We strive to enable you to exercise your rights over your personal data:
– You can access the personal data that Unity SC collects and processes about you and obtain a copy;
– You can request that your personal data be rectified, updated, or corrected;
– You can request the erasure of your personal data as soon as possible when one of the following reasons applies:

a) The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
b) You withdraw your consent on which the processing is based, and

there is no other legal ground for the processing. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;
c) You object to the processing, and there are no overriding legitimate grounds for the processing;
d) The personal data have been unlawfully processed;
e) The personal data have to be erased for compliance with a legal obligation.

The right to erasure shall not apply if processing is necessary:
o to comply with a legal obligation;
o for the establishment, exercise, or defense of legal claims.
– You can request the restriction of processing of your personal data when one of the following applies:
a) You contest the accuracy of your personal data, for a period enabling the controller to verify the accuracy of the personal data;
b) The processing is unlawful, and you oppose the erasure of the personal data and request the restriction of their use instead;
c) Unity SC no longer needs the personal data for the purposes of the processing, but they are required by you for the establishment, exercise, or defense of legal claims;
d) You have objected to processing pending the verification whether the legitimate grounds of the controller override those of the data subject.
– You can object at any time, on grounds relating to your particular situation, to processing of your personal data based on a legitimate interest;
– You can withdraw your consent to the processing of personal data at any time, under the same conditions as those under which you provided it, provided that the processing is based on consent (particularly concerning the processing of cookies);
– You have the right to data portability, allowing you to receive the personal data you have provided to Unity SC in a structured, commonly used, and machine-readable format when, cumulatively :

o the processing is based on consent or on a contract;

o the processing is carried out by automated means.

In the context of exercising this right, you have the right to have your personal data transmitted directly from Unity SC to another controller where technically feasible.

The right to data portability shall not adversely affect the rights and freedoms of others.

– In accordance with French law, Unity SC provides you the opportunity to decide in advance on the fate of your personal data after your death. Any rectification or erasure of your personal data or any restriction of processing carried out at your request will be communicated by Unity SC to each recipient to whom the personal data have been disclosed in accordance with these provisions, unless such communication proves impossible or involves disproportionate effort.

If the personal data concerning you are inaccurate or out-of-date, you can inform Unity SC so that the necessary corrections and/or updates can be made.
